Each participant will be required to sign the following Release, Waiver and Indemnity Agreement. Parents or guardians will be required to sign for each minor.
Release, Waiver, and Indemnity Agreement
Important: Please read this document carefully before signing. This is a legal agreement that affects your rights, including your ability to bring future legal claims.
1. Definitions
For purposes of this Agreement, “Vikings’ Edge LLC” includes its owners, members, employees, agents, instructors, independent contractors, volunteers, representatives, successors, and assigns.
2. Acknowledgment of Risks
I acknowledge that participation in the Activities involves inherent risks that could result in physical or emotional injury, paralysis, permanent disability, death, or property damage. These risks include but are not limited to falls; collisions; errant throws; equipment malfunction or misuse; injuries such as bruises, lacerations, sprains, or fractures; and medical conditions resulting from physical exertion. I understand that personal items and clothing may also be damaged.
3. Use of Personal Equipment
If I choose to bring or use any personal equipment (including but not limited to axes, safety gear, footwear, or apparel), I acknowledge that Vikings’ Edge LLC has not inspected, certified, or approved such equipment for safety or suitability. I accept full responsibility for any injury, damage, or harm caused by or arising from the use of personal equipment.
4. Alcohol Consumption and Michigan Social District Law
I understand that Vikings’ Edge LLC operates within a designated Social District as permitted under Michigan Compiled Laws § 436.1551 et seq., and that alcoholic beverages consumed on the premises must: - Be purchased from a licensed Social District establishment,- Be contained in an approved and clearly marked Social District cup, and- Be consumed only within the boundaries of the designated Social District.I acknowledge that:- No outside alcohol may be brought onto the premises except as permitted by law;- Vikings’ Edge LLC reserves the right to refuse participation or service to anyone appearing intoxicated or impaired;- I am solely responsible for ensuring compliance with all applicable Social District and alcohol-consumption laws.I release and hold harmless Vikings’ Edge LLC from any and all claims related to my possession, consumption, or effects of alcohol on or near the premises.
5. Assumption of Risk
I voluntarily assume all risks associated with participation. My participation is entirely voluntary, and I choose to participate despite these risks. If at any time conditions are unsafe or that I am unable to participate safely, I will immediately stop participating.
6. Release, Waiver, and Indemnification
I hereby voluntarily release, forever discharge, and agree to indemnify and hold harmless Vikings’ Edge LLC from all claims, demands, or causes of action related in any way to my participation or use of its facilities or equipment. If Vikings’ Edge LLC or its representatives incur attorney’s fees or other costs to enforce this Agreement, I agree to reimburse them.
7. Insurance and Medical Condition
I represent that I have adequate insurance to cover any injury or damage I may cause or sustain during participation, or I agree to bear such costs myself. I further represent that I have no medical or physical condition that could interfere with my safety, or I willingly assume all resulting risks.
8. Property Damage and Claims Waiver
I understand that if I am injured or my property is damaged during participation, I may be deemed to have waived my right to bring a lawsuit against the released parties.
9. Rules, Conduct, and Behavior
I agree to familiarize myself with and follow all written and/or posted rules of Vikings’ Edge LLC, including alcohol and safety policies. I will comply with all instructions and directions given by staff. I understand that failure to follow rules, or engaging in unsafe, disruptive, or unlawful behavior, may result in immediate removal without refund.
10. Age, Competence, and Digital Signatures
I affirm that I am at least 18 years old and legally competent to sign this Agreement. If signing electronically, I agree that my digital signature is legally binding and equivalent to a handwritten signature.
11. Arbitration and Venue
Any dispute or claim arising from this Agreement or my participation will be resolved by binding arbitration under the Commercial Arbitration Rules of the American Arbitration Association. Judgment on the arbitration award may be entered in any court of competent jurisdiction. All proceedings shall take place in Eaton County, Michigan. This clause shall be interpreted under MCL 600.5001 et seq.
12. Severability and Entire Agreement
If any provision of this Agreement is found invalid or unenforceable, the remaining provisions shall remain in full force and effect. This Agreement represents the entire understanding between the parties and may only be modified in writing signed by both parties.
13. Review and Understanding
I acknowledge that I have had sufficient time to read this document, consult legal counsel if desired, and ask questions. I understand that by signing, I am waiving substantial legal rights, including the right to sue. I agree that the opportunity to participate in exchange for signing this release is a fair and reasonable bargain.
14. Media Release
I grant permission for Vikings’ Edge LLC to use any photographs, videos, or images captured during participation for marketing purposes, including social media, websites, and promotional materials.
For Participants Under 18 Years of Age
By signing below, I affirm that I am the parent or legal guardian of the minor listed, and I consent to their participation. I understand that Vikings’ Edge LLC and its employees are not providing supervision or care for the minor. I assume full responsibility for any injury, property loss, theft, or damage involving the minor while on the premises or surrounding areas.
